David Cunningham of Worcester, weaver, was granted £4.10.0 damages and £3.19.1 costs in his suit against John Lambert of Taunton, gentleman, at the Taunton Court of Oct. 1763. An execution against Lambert was issued on Nov. 4, and the total amount of the suit was receipted by RTP as attorney on July 20, 1764 (RTP Papers).
I wrote you a Letter last April in which was Inclosed a Writ against Nathan Hodges Junr. in favr. of Gordon Hutchins of Harvard. The writ being not returned to May Court last I conclude the Letter miscarried or came to your Hands too late for Service. If you have got the writ I Should be obliged to you to alter it to our August Court, and if you have not got it I Should be obliged to you to draw another.1 There are four Notes all Dated Novr. 4, 1762 three of them for £1:15.0 each the other for £1.0.0 & all payable to Gordon Hutchins or order on Demand & on Interest. I wrote in the aforsd. Letter of my Purpose of going to Taunton but at the Time I sat for my Journey I was detained by unexpected business & ever Since I have been unable to ride or to do any business except the week after ct. which time I went to Boston & had thoughts of then going to Taunton but I there heard you was gone to Rhode Island and now I have put off all thoughts of Such a Journey till the fall. If you come to Commencement I hope you will call at Lancaster before you go home and see your old Friend. I am Sr. yr. Sincere Friend
This action was not entered in the Worcester County Court of Common Pleas at the August term or subsequently. The case was presumably settled out of court.
