Mr: Russell1 was here sometime past & Enquireing abt. the Execo. of his you mention when I recd. that Execon. I was told that he sailed out of this town in Pearses Employ, as I was then Lame & confined I gave it Cotton to take him upon the Vessels comeing in who accordingly watched for & found when She came that it was a mistake upon which I directed him to make a general Enquiry for him. which he says he did but never could find such a man & has retd. the Exceo. accordingly. If you think proper to renew it when you go to Boston & send it to me I will take all the care I can of it. With regard to the affair of Whitmarsh I wrote to him soon after the rect. of your former Letter2 in a manner that I presume will bring the matter to a fair Issue but as yet have had no497answer. This probably refers to the case of Caleb Russell v. Bani Teague which was heard by the Superior Court in their May 1771 session at Plymouth. Paine represented Russell who was awarded damages and costs in the case. The execution was issued on June 24, 1771 (Minute Book, Superior Court, Plymouth County).
